The SR3370 scissor lift pictured (S/N 070627) has been offered for sale on Trade Me. The EWPA believes that this machine is unsafe and that buyers should avoid it.
The machine was badly damaged when dropped from a crane, written off by its insurer and then repaired against its manufacturer's advice.
The Department of Labour has recently clarified obligations in respect of EWP safety certification. Anyone employing this machine or allowing it into their workplace or site may be liable as a duty-holder under the HSE Act. The implications for your insurance status are also likely to be significant.
It should be noted that, while the damaged machine has a Hirepool sticker on it, the actions of repairing it and offering it for sale have occurred after Hirepool's insurance company "bought" the machine from Hirepool.

b) Was the inspector issuing the ccertifiacte compentent?
c) the insurance companies might like to check where it goes for they may be insuring a piece of equipment that is not fit for purpose. For it has been repaired against the advice of the manaufacturer.
b) The inspector was not CBIP certified. A CBIP certified inspector refused to certify the machine, as did the manufacturer.
c) The insurer would probably say they sold the wreck 'as is' for parts or scrap, as they do with cars. Before doing this, they should have removed the manufacturer's plate from the machine.
